SoftAgility LLC (“SoftAgility,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use SoftAgility Beacon and related services (the “Service”). Please read this policy carefully. If you disagree with its terms, please discontinue use of the Service.

1. Information We Collect

1.1 Information You Provide Directly

We collect information you provide when you register for an account, subscribe to a plan, or contact us for support, including:

  • Name and email address
  • Company name and job title
  • Billing information (processed by our payment processor; SoftAgility does not store full card numbers)
  • Communications you send us (support requests, feedback)

1.2 Information Collected Automatically

When you use the Service, we automatically collect:

  • Usage data — features accessed, actions taken, frequency and duration of use
  • Device and browser information — browser type, operating system, screen resolution
  • IP address and approximate geographic location (country/region)
  • Log data — timestamps, pages viewed, errors encountered
  • Cookies and similar tracking technologies (see Section 6)

1.3 Customer Data

As part of providing the Service, SoftAgility processes data that you or your end users submit to the platform (“Customer Data”). SoftAgility acts as a data processor with respect to Customer Data and processes it only on your instructions as described in these Terms and our Data Processing Agreement (available upon request).

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process payments and manage your Subscription
  • Send transactional communications (receipts, account alerts, security notices)
  • Send product updates, feature announcements, and marketing communications (you may opt out at any time)
  • Analyze usage patterns to improve and develop the Service
  • Detect, investigate, and prevent fraud, abuse, or security incidents
  • Comply with legal obligations and enforce our Terms of Service
  • Respond to your support requests and inquiries

3. Legal Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA), we process your personal data on the following legal bases:

  • Contract performance — to provide the Service you have subscribed to
  • Legitimate interests — to improve our Service, prevent fraud, and communicate product updates
  • Consent — for marketing communications and non-essential cookies (you may withdraw consent at any time)
  • Legal obligation — where processing is required to comply with applicable law

4. How We Share Your Information

4.1 Service Providers

We share information with trusted third-party vendors who assist us in operating the Service, including:

  • Analytics platforms for aggregated usage insights

All service providers are bound by contractual obligations to process data only as instructed and to implement appropriate security measures.

If SoftAgility is involved in a merger, acquisition, or sale of all or substantially all of its assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our website prior to your data being subject to a different privacy policy.

4.3 Legal Requirements

We may disclose your information if required to do so by law, court order, or governmental authority, or if we believe in good faith that such disclosure is necessary to protect our rights, your safety, or the safety of others.

4.4 No Sale of Personal Data

SoftAgility does not sell, rent, or trade your personal information to third parties for their own marketing purposes.

5. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Service. Upon account termination:

  • Account data is retained for 30 days to allow for re-activation or data export
  • After 30 days, personal data is deleted or anonymized from our systems
  • We may retain certain data longer where required by law (e.g., financial records for tax purposes)
  • Aggregated, anonymized analytics data that cannot identify you may be retained indefinitely

6. Cookies and Tracking Technologies

6.1 What We Use

We use cookies and similar technologies to:

  • Authenticate your session and keep you logged in
  • Remember your preferences and settings
  • Analyze how the Service is used (via analytics tools)
  • Detect and prevent security threats

6.2 Your Choices

Depending on your location, you may have the following rights with respect to your personal data:

  • Access — request a copy of the personal data we hold about you
  • Correction — request that we correct inaccurate or incomplete data
  • Deletion — request that we delete your personal data, subject to legal retention requirements
  • Portability — request a machine-readable copy of your data
  • Objection — object to our processing of your data for direct marketing or legitimate interest purposes
  • Restriction — request that we restrict processing of your data in certain circumstances
  • Withdrawal of consent — where processing is based on consent, you may withdraw it at any time

To exercise any of these rights, please email us at privacy@softagility.com. We will respond within 30 days (or within the timeframe required by applicable law). We may need to verify your identity before processing certain requests.

9. Children’s Privacy

The Service is not directed to individuals under the age of 16. We do not knowingly collect personal information from children. If we become aware that a child under 16 has provided us personal information, we will delete it promptly. If you believe we have collected such information, please contact us at privacy@softagility.com.

10. International Data Transfers

SoftAgility is based in the United States. If you access the Service from outside the United States, your information may be transferred to and processed in the United States. If you are located in the EEA or UK, we rely on appropriate safeguards for such transfers, including Standard Contractual Clauses approved by the European Commission. Please contact us if you would like more information about these safeguards.

11. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • The right to know what personal information we collect, use, disclose, or sell
  • The right to request deletion of your personal information
  • The right to opt out of the sale of your personal information (note: SoftAgility does not sell personal information)
  • The right not to be discriminated against for exercising your privacy rights

To submit a CCPA request, email us at privacy@softagility.com with “CCPA Request” in the subject line. We will respond within 45 days.

12. Third-Party Links

The Service may contain links to third-party websites or integrations. SoftAgility is not responsible for the privacy practices of those third parties and encourages you to review their privacy policies before providing any personal information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice within the Service at least 14 days before the change takes effect. Your continued use of the Service after the effective date of any change constitutes acceptance of the updated policy. The date at the top of this policy reflects when it was last updated.
